The Terms of Use govern any purchase or other services provided; the use of the Carbon Advice Group Websites (including carbonadvicegroup.com, carbonvie.com, carboncreditshop.com) and other websites within the Carbon Advice Group of Companies and your relationship with Carbon Advice Group.

All intellectual property rights associated with this website, including but not limited to its structure, content, functionality, code and branding, are owned by Carbon Advice Group.

Carbon Advice Group collects various data from you to be able to offer you its carbon offsetting services. This data may include, but is not limited to:

1. Your name, address and other contact details
2. Information about your personal carbon footprint
3. Financial information (such as payment details)
4. How you would like us to contact you
5. Username, password and other site registration details

We may also collect information about your visit to the site automatically, such as your IP address, which pages you visit, and for how long. This information helps us to improve the overall user experience on the Group's sites.

We will use statistical details of your visits to the sites for the following:

1. improving your browsing experience
2. improving the content and overall user experience
3. General, anonymous information may also be used by us for:

5. research and marketing purposes

We may use your personal information:

1. to send you any documentation and manage your account with us
2. to keep details on file of your carbon footprint
3. to communicate with you regarding all aspects to do with reducing your carbon footprint, saving energy or reducing your household bills expenditure

7. to provide details to new business partners or owners if our business enters into a commercial agreement, joint venture with, or is sold to or merged with, another business entity

The Carbon Advice Group uses strict security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage both on-line and off-line. However Carbon Advice Group cannot guarantee the security of data transmitted across the internet.

You are responsible for keeping your password confidential, and for changing it regularly.

Users under the age of 16 acting without their parent's or guardian's permission are not allowed to provide us with personal information.

Carbon Advice Group's website contains links to other websites which are outside our control and are therefore not covered by this Privacy Policy. Any information collected from you on such sites will be used by them in accordance with their privacy policy, which may differ from this one.

You may view, print or download (for caching purposes only) pages and elements of the websites within the Carbon Advice Group, provided that:

1. it is for personal, non-commercial use and,
2. none of the information, content, structure, functionality, code, branding or applicable notices are removed, altered, adapted or obscured,

unless you have specific written consent from Carbon Advice Group.

Press releases from the site may be reproduced for editorial purposes in daily newspapers, general circulation news magazines, trade publications and broadcast media; however written permission is required for any other variation from the Allowed Usage

Carbon Advice Group uses its own proprietary carbon footprint calculators (the "Calculators") to calculate your carbon footprint, and aims to provide the most representative calculation of emissions available. They are designed to adhere to the latest DEFRA guidelines. In the absence of a universally agreed standard, all Calculators and their results are based on the information provided by you and the data and scientific knowledge available at the time of calculation. Given the dynamic nature of the underlying information, Carbon Advice Group cannot accept any responsibility or liability for differences in the results with other calculators, changes to calculators over time or subsequent changes to the calculation, assumptions or results in the future. Carbon Advice Group is not responsible for the accuracy of the information that is entered into our calculation engines on which the carbon footprint calculations are based.

Carbon Advice Group provides merchandise to customers, such as such as windscreen discs, luggage labels, keyrings, card wallets and fridge magnets. These merchandise items have no intrinsic value, are not transferable and at all times remain the property and copyright of Carbon Advice Group. Where included, these products are an integral and non-negotiable part of the purchase, and are not separately refundable. Our merchandise is individually tailored to you. As a result it can take several working days to prepare and complete an order (typically 3-5 working days).

When you offset your carbon footprint with us, the Carbon Advice Group will, within a maximum six month period from the date of purchase (in line with DEFRA Guidelines) purchase an equal number of Carbon Offsets to remove, absorb, reduce, cancel or avoid the required amount of CO2 emissions to offset your calculated carbon footprint. Offsets are measured in "tonnes of CO2 equivalents". We will source these offsets via one or more certified or verified emissions reductions projects worldwide (the "Portfolio"). All prices quoted on this website include UK Value Added Tax.

We may buy these offsets from a number of sources:

1. projects on the registry or likely to be put forward for verification by the registry of the United Nations;
2. projects which have followed one of the clean development mechanisms of the United Nations;
3. projects verified by independent third parties or meeting a recognised publicly available standard e.g. the Voluntary Carbon Standard;
4. investments in funds, companies, or projects which result in emission reductions globally
5. investments in environmental, sustainable or renewable energy projects including the promotion of environmental or green themes.

Offsets may have already been realised or delivered or for future realisation or delivery.

The contents of a Portfolio may change without notice. Although we will make reasonable efforts to ensure that the preferences of the customer as to the Portfolio are met, an Alternative Offset Portfolio may have to be substituted.

We will refund any purchase on the site, provided that we are notified in writing within seven days of the purchase. We will only issue refunds beyond this time frame at our own discretion and in exceptional circumstances. With Merchandising we only accept returns if they have been incorrectly completed due to an error on our part, in which case we will be happy to refund the charges incurred in sending the item to you and your postage costs in returning it to us so we can send you a new one. Unfortunately it is not possible once a purchase has been made to cancel or refund any administration charges.

The Terms of Use are the only part of this site intended to form any binding contract. In particular, notes on products and services are stated on an 'invitation to treat' basis and are 'subject to availability'.

Whilst we endeavour to keep the information on this site accurate and current, we do not make any warranty as to its completeness or accuracy; nor do we guarantee its availability. We will not be liable for any direct, indirect or consequential loss or damage arising under these Terms of Use or in connection with our website, including any loss of business, profit, contracts, data, income, revenue, goodwill, reputation or anticipated savings. If you are dissatisfied with any portion of this site, your sole and exclusive remedy is to discontinue using it.

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.
